Terms of Service

These Terms of Service ("Terms") are a binding agreement between you and Jedizer Tecnologia Ltda, registration CNPJ 41.130.328/0001-00, with its address at Rio do Sul, SC, 89163-518, Brasil ("World Kings", "we", "us"), which operates the game available at worldkings.lol and in any related applications (the "Service").

Please read these Terms carefully. By creating an account, or by using or paying for the Service, you confirm that you have read, understood and accepted these Terms and our Privacy Policy. If you do not agree, do not use the Service.

1. What World Kings is

1.1. World Kings is an online entertainment game with a public showcase and social features. Players contribute money to climb a ranking of fictional titles (such as King, Queen, Duke or Knight) attached to game territories, and a world ranking that adds up each player's contributions across all territories. Each position displays the player's public profile, which people and companies may use to present themselves or to promote a business. The social features of the Service include public profiles, content and links published by players, the sharing of titles and pages, and a public feed of coronations. These features, and all content published through them, are subject to sections 6 (Your content) and 7 (Acceptable use).

1.2. The territories are fictional game units. Game territories share names with real countries, states, provinces and cities only so that players can recognize them. They are not the real places. A game territory, a position in a ranking or a title:

• grants no ownership, property, sovereignty, citizenship, nobility, political, administrative, legal or commercial right of any kind over any real place, person or institution;
• does not represent, and is not endorsed by, any government, public authority, municipality, community or organization connected to the real place;
• does not express any political opinion or position by World Kings about borders, names, sovereignty or the status of any territory.

1.3. The list of territories, their names, hierarchy and borders comes from public geographic datasets and may be incomplete, outdated, disputed or inaccurate. We may add, rename, merge, split, move or remove game territories at any time. When we do so, we will make reasonable efforts to preserve the totals already credited to players, for example by moving them to the corresponding territory.

1.4. Titles are purely playful labels inside the game. Using a title outside the Service to suggest any real authority, affiliation or right is not allowed.

2. Who can use the Service

2.1. You must be at least 18 years old and have full legal capacity to enter into contracts in your place of residence. The Service is not directed to minors, and we will close accounts we believe belong to minors.

2.2. A company or other organization may have an account. The person who creates it declares that they are authorized to accept these Terms on its behalf, and the organization is bound by them.

2.3. You may not use the Service if you are located in, or are a resident of, a country or region subject to comprehensive sanctions, or if you are on any sanctions list, or if using the Service is prohibited by the laws that apply to you.

3. Your account

3.1. You can sign in with a Google account or with a one-time code sent to your email. You must provide accurate information and keep access to your email and sign-in method secure. You are responsible for all activity carried out through your account.

3.2. Your username, display name, photo or logo, bio, country and social links form your public profile. You must not impersonate any person, company, brand, public authority or official, nor suggest an affiliation that does not exist.

3.3. We may reclaim or change usernames that violate these Terms, infringe third-party rights, or are reserved for the operation of the Service.

4. Contributions and how the game works

4.1. What a contribution is. A contribution is a payment you make to have a digital amount credited to your total in a city you choose. Only the lowest-level game territories accept contributions directly: cities, and the few countries, states or provinces that have no cities in the game. The minimum contribution is US$ 2. All amounts are in United States dollars (USD). Your bank or card issuer may charge currency conversion or other fees, which are your responsibility. Taxes may apply where required by law.

4.2. What you receive. In exchange for a contribution you receive a personal, non-exclusive, non-transferable and revocable license to have that amount counted in the rankings of the Service, under these Terms. The contribution is consumed and fully delivered at the moment the payment is confirmed and your total is updated.

4.3. How rankings work.

• Your total in a city is the sum of your confirmed contributions to it. Contributions are cumulative.
• A contribution to a city also counts, automatically and in the same amount, toward the state or province and the country that contain it. Your total in a state, province or country is the sum of your totals in the cities inside it. These thrones cannot be bought directly.
• Players are ordered by total, from highest to lowest. When two totals are equal, the player who reached that total first stays ahead.
• Your position defines your title in that territory. The first position holds the throne.
• Your world total is the sum of all your confirmed contributions, counted once, and it defines your position in the world ranking.
• Any player can contribute more at any time. Other players may overtake you at any moment, and no position, title or throne is guaranteed for any period of time.

4.4. What a contribution does not buy. A contribution does not buy a fixed position, a title or a throne for any period of time, visits to your profile or to your social networks, followers, customers, revenue, search-engine visibility, an endorsement by World Kings, or any exclusive right over a territory. It buys only the counting of the amount in the rankings, under these Terms.

4.5. No monetary value. Totals, positions and titles have no monetary value outside the game. They are not money, electronic money, a deposit, a credit, a security, an investment, a financial product, a collectible or a crypto asset. They cannot be sold, transferred, exchanged, withdrawn or redeemed for cash, goods or services, and they do not generate any return, interest, prize or profit. Contributions are not donations to any charity or public entity.

4.6. No chance. The result of the game depends only on the amounts credited to the players, meaning their contributions and any promotional coupons under section 4.11, and on the rules above. There is no draw, randomness or prize for players.

4.7. Payment processing. Payments are processed by Stripe. We do not receive or store your full card details. By paying, you also accept the terms of the payment method you use. We may refuse or cancel any payment, for example in case of suspected fraud, error or violation of these Terms.

4.8. Immediate delivery and refunds. When you confirm a payment, you expressly ask us to deliver the digital content immediately and acknowledge that, once it is delivered, contributions are final and non-refundable, and that you lose any right of withdrawal to the extent permitted by the law that applies to you. This does not affect:

• refunds of charges made in error, duplicated or unauthorized, which you can request at support@worldkings.lol;
• any right that cannot be excluded or limited under the consumer protection law of your place of residence. If such a right applies to you and you exercise it, the corresponding amount will be removed from your totals.

4.9. Refunds and chargebacks. If a payment is refunded, reversed, disputed or charged back, the corresponding amount is removed from your totals and your positions are recalculated. Disputing or charging back a payment without a legal basis, instead of contacting us, is a breach of these Terms and may lead to the suspension of your account.

4.10. Corrections. If an error in our systems credits an incorrect amount or produces an incorrect position, we may correct it.

4.11. Promotional coupons. Coupons are promotional offers that we choose to give, at our discretion and in limited quantities, for example to people we invite on social networks. We may deliver them through links we share or directly in your account. We currently give every new account a welcome coupon of US$ 2 (two US dollars), credited to the account after signup and valid for 30 days from when it is granted. The welcome coupon is personal: only the account that received it can use it. It counts as that account's one coupon, so an account that uses another coupon first can no longer use the welcome coupon. We may change the value of the welcome coupon or end this offer at any time, without affecting welcome coupons already granted. A coupon is not a draw, contest or prize, and, except for the welcome coupon while that offer is active, nobody has a right to receive one. A coupon adds the value stated on it to your total in one eligible city that you choose when you redeem it, and that value counts in the rankings in the same way as a contribution. In addition:

• the value of each coupon is set by us at our discretion and may differ between campaigns and between coupons;
• each coupon can be used only once, with a limit of one coupon per person and per account;
• a coupon is valid until the expiry date shown on it;
• coupons have no cash value and cannot be sold, exchanged, transferred, refunded or converted into money;
• the value credited by a coupon is not a payment made by you and gives no right to a refund;
• we may cancel coupons, and remove the related value from your totals and from the rankings, in case of fraud, multiple accounts, use of automation, resale or any other abuse;
• we may end a coupon campaign at any time;
• the rest of these Terms applies to coupons and to the value they credit.

5. Changes to the game

We may improve, change or discontinue features of the game, including titles, the number of titles, visual elements and the way rankings are displayed. Such changes will not retroactively reduce totals already credited to your account, except in the cases of refunds, chargebacks, fraud, errors or violations of these Terms. If we permanently shut down the Service, we will give reasonable advance notice.

6. Your content

6.1. You are responsible for everything you publish on your profile, including names, images, texts and links ("Your Content"). You declare that you own Your Content or have all necessary rights to publish it, including rights over trademarks, logos and images of people.

6.2. You grant us a worldwide, non-exclusive, royalty-free license to host, reproduce, display, adapt (for example, resize) and distribute Your Content in the Service and in materials that promote the Service or that you share, such as preview images of links, for as long as Your Content remains in the Service and for a reasonable period after that to remove it from caches and backups.

6.3. You must not publish content that:

• is illegal, defamatory, fraudulent or misleading;
• promotes hatred, violence, terrorism, discrimination or harassment;
• is sexual, obscene or exploits minors in any way;
• infringes intellectual property, image, privacy or other rights of third parties;
• impersonates people, companies, brands, public authorities or officials;
• contains political or electoral propaganda, or misuses titles to suggest real authority;
• contains personal data of other people, spam, malicious links or links to illegal content.

6.4. We may, without prior notice, remove or hide any content, change your username or display name, hide your profile from rankings, or suspend or close your account if we believe these Terms or the law have been violated. Other players can report profiles to us.

6.5. Complaints and rights notices. If you believe that a profile infringes your rights (for example your name, image, trademark or copyright) or is unlawful, you can report it in the Service or write to support@worldkings.lol with: (1) your name and contact details; (2) the link to the profile; (3) a description of the problem; and (4) a statement that the information is accurate and that you are the rights holder or are authorized to act for them. We may hide the content while we review the notice and may share the notice with the player concerned. Repeated or abusive notices may be ignored.

6.6. Profiles used as advertising. Profiles, logos, taglines and links shown on thrones, rankings and profile pages are published by the players. When they promote a business, product or service, they are paid advertising by that player, and positions are marked as paid in the Service. World Kings does not review, verify, endorse or guarantee any person, product, service, offer, claim or website shown by players. If you use your profile to promote a business:

• you must be authorized to represent that business and to use its name, logo and trademarks;
• you are responsible for complying with advertising, consumer protection, privacy and any other laws that apply to what you promote;
• the website or profile you link to must clearly identify who is responsible for it;
• you must not promote adult or sexual content, gambling or betting, financial, investment, health or other offers that require a license you do not have, weapons, counterfeit goods, malware or phishing, chat or messaging groups, or link shorteners that hide the destination.

We may remove any profile content or link that breaks these rules, without refund. We count visits to player links and show the count on the profile. The count is informative and does not guarantee any number of visits, customers or results.

7. Acceptable use

You agree not to:

• use bots, scripts or automated means to access, scrape or interact with the Service, except through interfaces we officially provide;
• exploit bugs or vulnerabilities, or interfere with the security or operation of the Service;
• use payment methods that are not yours or that you are not authorized to use;
• use the Service for money laundering, terrorist financing, evasion of sanctions or any other illegal purpose;
• create accounts to manipulate rankings in ways that violate these Terms, or sell, rent or transfer accounts;
• use the Service to harass, threaten or harm other people.

8. Suspension and closure

8.1. You can delete your account at any time in the settings. When you do, your profile and positions are removed from the rankings and your thrones pass to the next players in line. Contributions are not refunded when you delete your account.

8.2. We may suspend or close your account, and hide or remove your positions, if you violate these Terms, if required by law, or to protect players, third parties or the Service. When the closure results from your violation, the amounts contributed are not refunded, to the extent permitted by law.

8.3. We keep payment records as required by tax, accounting and anti-fraud obligations, as explained in the Privacy Policy.

9. Intellectual property

The Service, including its name, logo, design, texts, software and visual elements, belongs to World Kings or its licensors and is protected by law. Except for the limited right to use the Service under these Terms, no right is granted to you. Geographic place data comes from GeoNames and is used under the Creative Commons Attribution 4.0 license.

10. Third-party services

The Service relies on services provided by third parties, such as Google (sign-in and, with your consent, analytics), Stripe (payments), Supabase (database and authentication), Vercel (hosting) and Resend (email). Their use of your data is described in our Privacy Policy. Links to social networks and websites of players lead to third-party services for which we are not responsible.

11. Disclaimers

The Service is provided "as is" and "as available". To the maximum extent permitted by law, we make no warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, uninterrupted availability or absence of errors. Nothing in these Terms excludes warranties that cannot be excluded under the law that applies to you.

12. Limitation of liability

12.1. To the maximum extent permitted by law, World Kings will not be liable for indirect, incidental, special, consequential or punitive damages, loss of profits, loss of reputation or loss of data, nor for the conduct or content of other players.

12.2. To the maximum extent permitted by law, our total liability for any claim related to the Service is limited to the total amount you paid us in the twelve (12) months before the event that gave rise to the claim.

12.3. These limitations do not apply to liability that cannot be limited by law, such as liability for fraud, willful misconduct or, where applicable, death or personal injury caused by negligence.

13. Indemnification

To the extent permitted by law, you will indemnify World Kings against claims, damages and expenses, including reasonable legal fees, arising from Your Content, your violation of these Terms or your violation of the rights of third parties.

14. Changes to these Terms

We may update these Terms. When a change is material, we will ask you to review and accept the new version before you continue to use your account, and the date at the top of this page will change. Changes do not apply to contributions confirmed before they take effect.

15. Governing law and disputes

15.1. These Terms are governed by the laws of the Federative Republic of Brazil, and disputes will be resolved in the courts of the district of Rio do Sul, Santa Catarina, Brazil.

15.2. If you are a consumer, you also keep the protection of the mandatory provisions of the law of your country of residence, and you may bring claims before the courts that this law allows.

15.3. Before starting any dispute, please contact us at support@worldkings.lol so that we can try to solve the problem in good faith.

16. General provisions

• If any provision of these Terms is found invalid, the remaining provisions stay in effect.
• Our failure to enforce a provision is not a waiver of it.
• You may not transfer your rights under these Terms. We may transfer them in the context of a reorganization, merger or sale of the business.
• These Terms, together with the Privacy Policy and the Cookie Policy, are the entire agreement between you and us about the Service.
• These Terms may be offered in several languages. If there is any conflict between versions, the English version prevails, except where the law of your place of residence requires otherwise.
